By creating an account or using Engine Pulse, you agree to these terms. If you don't agree, don't use Engine Pulse.
1. Advisory only
Engine Pulse is an advisory tool. It is not FAA-approved, and it is not a required instrument or a substitute for one.
- Engine Pulse never replaces your POH/AFM and its supplements, your aircraft's instruments and engine monitor, or the judgment of your A&P or IA.
- As pilot in command, you are directly responsible for, and are the final authority on, the operation of your aircraft (14 CFR 91.3). The owner or operator is responsible for keeping the aircraft airworthy (14 CFR 91.403).
- Findings, scores and trends can be wrong or incomplete. They depend on the data your avionics record, on the files you upload, and on how the app reads your documents. A clean result doesn't mean your engine is airworthy, and a finding doesn't mean it isn't.
- Never use Engine Pulse to decide whether an aircraft is safe to fly. Have any concern checked by a qualified mechanic.
- The airworthiness-directive check is a convenience. It doesn't establish AD compliance. Confirm applicability and compliance with your mechanic and the FAA's official records.
2. Your account
- You must be at least 18 years old, or the age of majority where you live, to create an account.
- Give accurate information and keep your sign-in details secure. You're responsible for what happens under your account.
- You may add only aircraft you own, operate or maintain, or that the owner has allowed you to add.
- Once your aircraft's limits have been read and checked, the profile locks to protect the data. Changes go through support.
3. The beta
Engine Pulse is currently in beta through Apple's TestFlight. Beta versions may have bugs, may change or lose features, and may be unavailable at times. Beta testers use Engine Pulse free until it launches on the App Store. We may end the beta, or your participation in it, at any time. We welcome feedback, and we may use it to improve Engine Pulse without any obligation to you.
4. Subscription and trial
After the App Store launch, Engine Pulse is offered as an auto-renewing subscription, billed through Apple:
- A 15-day free trial for new subscribers, then $14.99 per month (or the price shown in the App Store for your region).
- Payment is charged to your Apple ID when you confirm the purchase, or when the trial ends.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within the 24 hours before the period ends.
- You can manage or cancel your subscription in Settings > Apple ID > Subscriptions on your iPhone or iPad.
- Any unused part of a free trial ends when you buy a subscription.
- Refunds are handled by Apple under its policies.
Your purchase is also subject to Apple's Licensed Application End User License Agreement (the standard EULA) and Apple's Media Services terms. If we change the price, Apple will let you know as its rules require.
5. Your data
You keep ownership of the flight logs, documents and other content you upload. You give us a limited license to store, copy, process and display that content only as needed to run Engine Pulse for you, for example to analyze your flights and sync them across your devices. This license ends when you delete the content or your account, apart from short-lived backups.
You confirm that you have the right to upload what you upload. Your POH and manuals are used privately for your own account; we don't publish or share them. Our Privacy Policy explains how we handle your data.
6. Acceptable use
Don't:
- try to get into other people's accounts or data, or get around security or the profile lock;
- upload malware, or content you don't have the right to share;
- overload, disrupt, scrape or reverse-engineer Engine Pulse, except where the law allows it; or
- use Engine Pulse in a way that breaks the law or these terms.
7. Our software
Engine Pulse, its software, design and content belong to Engine Pulse. We grant you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, and the website, under these terms and Apple's standard EULA. Product names such as Garmin, Cirrus and Tornado Alley belong to their owners; we mention them only to describe compatibility.
8. No warranty
To the fullest extent the law allows, Engine Pulse is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Engine Pulse will be error-free, uninterrupted, or that it will detect any particular condition.
9. Limitation of liability
To the fullest extent the law allows:
- We are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or use, arising from or related to Engine Pulse.
- We are not liable for any damage to an aircraft, engine or property, or for any injury, arising from decisions made using Engine Pulse, including decisions to fly or not to fly, or to perform or defer maintenance.
- Our total liability for any claim related to Engine Pulse is limited to the greater of the amount you paid for Engine Pulse in the 12 months before the claim, or $50.
Some places don't allow some of these limits, so they may not all apply to you.
10. Ending these terms
You can stop using Engine Pulse and delete your account at any time in the app (ACCOUNT, then Delete account). Deleting your account doesn't cancel an Apple subscription; cancel that in Settings. We may suspend or close an account that breaks these terms, or stop offering Engine Pulse, with reasonable notice where we can give it. Sections 1, 5 (for data you leave with us), 7, 8, 9 and 12 survive after these terms end.
11. Changes
We may update these terms. We'll change the date at the top and, for material changes, tell you in the app or by email before they take effect. If you keep using Engine Pulse after that, the new terms apply.
12. Governing law
These terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. Any dispute will be heard in the state or federal courts located in Maricopa County, Arizona, unless the law where you live requires otherwise.
13. Apple
These terms are between you and Engine Pulse, not Apple. Apple isn't responsible for Engine Pulse or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
